These Terms of Use (“Terms”) are an agreement between you and 3ring, LLC (“3ring”, “we”, “us”), which operates AllergyHunter.com and its apps and services (together, “AllergyHunter” or the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. You must be at least 18
You must be at least 18 years old to create an account or use the Service. By agreeing to these Terms, you confirm that you are at least 18 years old and that the date of birth you give us is true. We will refuse or close any account that we believe belongs to someone under 18.
2. Not medical advice
AllergyHunter is a personal diary and pattern-finding tool. It is not a medical device, and it does not diagnose, treat, cure or prevent any disease or condition. Findings, scores, flags, alerts and other information in the Service, including anything labeled a “Likely trigger” or “Worth watching”, are patterns in the information you enter. They are not a diagnosis or a recommendation. Always talk to a doctor, allergist or other qualified health professional before making decisions about your health, diet or medication, and never ignore professional advice or delay seeking it because of something in the Service.
If you have a severe reaction or think you may be having a medical emergency, call 911 or your local emergency number right away. Do not rely on the Service in an emergency.
3. Provided “as is”
THE SERVICE AND ALL INFORMATION, FINDINGS AND CONTENT IN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, 3RING DISCLAIMS ALL WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND COMPLETENESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT ANY FINDING OR ALERT WILL BE CORRECT, OR THAT ANY ALLERGEN, INGREDIENT OR RECALL WILL BE DETECTED.
4. AI, product and recall information
The Service uses artificial intelligence and third-party data, including product, ingredient and recall information from sources such as the U.S. Food and Drug Administration, the U.S. Department of Agriculture and Open Food Facts. This information can be incomplete, out of date or wrong, and AI can misidentify foods, products and ingredients. Always read the product label, check with the manufacturer and follow your health professional’s advice. A missing warning does not mean a product is safe for you.
5. Your responsibilities
You are responsible for the accuracy of the information you enter, for keeping your password private, and for everything that happens under your account. You agree not to misuse the Service, including by trying to access other people’s accounts or data, interfering with the Service, uploading anything unlawful or harmful, or copying, reselling or redistributing the Service or its data without our written permission.
6. Your information
You keep ownership of the information you enter. You allow 3ring to store and process it to run, secure and improve the Service, and to send it to the service providers we use to run the Service (for example, to analyze a photo you scan). We may use information that has been combined and de-identified so it cannot reasonably identify you, for example to improve our pattern detection. We do not sell your personal information. AllergyHunter is not a substitute for your medical records.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL 3RING, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, LOSS OF DATA, LOSS OF PROFITS OR OTHER LOSS, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY INFORMATION IN IT, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT BE MORE THAN THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50. SOME PLACES DO NOT ALLOW CERTAIN LIMITS ON LIABILITY, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.
8. Assumption of risk and release
You understand that food, environmental and medication allergies and intolerances can be serious, and you accept all risk of relying on the Service. To the fullest extent permitted by law, you release 3ring from any claims arising from decisions you make based on the Service.
9. Indemnity
You agree to defend, indemnify and hold harmless 3ring and its owners, members, officers, employees and agents from any claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, the information you enter, or your breach of these Terms.
10. Accounts, changes and ending the Service
We review new accounts before switching them on and may decline any account. We may suspend or close an account that breaks these Terms or that we believe puts the Service or other people at risk. We may change, suspend or stop any part of the Service at any time. We may update these Terms; if we make a significant change, we will let you know through the Service or by email, and continuing to use the Service after that means you accept the updated Terms. You may stop using the Service at any time and can ask us to close your account.
11. General
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules, and any dispute will be handled in the state or federal courts located in Virginia. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms are the entire agreement between you and 3ring about the Service.
